摘要
悬赏广告自古有之,在现代社会尤为常见,在法理上又是一个极为复杂的问题。其复杂性在于对悬赏广告法律性质认识的不统一,学术界和实务界历来存在着合同行为说和单方法律行为说两种观点。笔者认为应将其视为单方法律行为而非契约更为合理。
The advertisement offering a reward has been in exsitence from the ancientry,and particularly common at modern society.In the jurisprudence,it is an extremely complicated problem,Its complexity lies in the different thought of the character , There are two doctrines,contract and singal behavioar of law.The writer thinks it is more reasonable that the advertisement offering a rewarde should be singal law behavoar rather than contract.
