国外反倾销、反补贴与中国市场经济地位关系分析

Analysis of Relationship between External Anti-dumping,Countervailing and China's Market Economic Status

我国产品频频在反倾销中处于需要用第三国的成本数据来作为我国出口产品成本依据的不利地位。这引发了中国入世议定书中的我国市场经济地位问题。然而重要的是市场经济地位的承认并不能够真正减少贸易摩擦,只不过这种摩擦由一些反倾销诉讼可能演变为反补贴诉讼而已。因此,我国在应对国际反倾销、反补贴等贸易摩擦中,应当采取更加灵活和务实的态度来解决国际贸易中出现的贸易摩擦和贸易纠纷。

This paper analyzes our products disadvantage status in the process of anti-dumping which needs other counting's cost datas as our exported products' cost basis. This brings about the problems of our China's market economic status in China's Accession World's Trade Instrument. Yet. The most important thing is that admission of market ecnomic status can't really reduce trade conflicts which change anti-dumping proceedings into countervailing. Therefore, on the basis of profound analysis the issue, this paper provides some princinples and suggestions to reduce conflicts.
