摘要
现代各国刑事立法对于正当防卫大都给予了相当的关注,认定正当防卫应以“正当化”为根据,并以“紧急不法侵害”的存在及“防卫”行为为要件。
Modern countries'criminal legislation has mostly paid the suitable concern to self-defence, they believe that it should be based on the ' proper foundation ' , what is more ,it should have 'the emergent illegal violation' and 'the defence' action as its conditions.
