国际私法中法律规避问题探析

Legal Evasion in the International Private Law

法律规避是国际私法中的一个重要问题,法律规避现象的产生有多方面的原因,法律规避的对象不仅应包括内国法,还应包括外国法,不管是规避内国法还是规避外国法的行为均应认定为无效,为了解决法律规避问题,我国应当制定专门法。

The legal evasion is an important problem in the i nt ernational private law , there are reasons in many aspects in the production of the phenomenon of evasion of law. The target of the evasion should include not o nly some national law, but also the foreign law , the two kinds of evasion shoul d be both regarded as invalid. For this problem, China should make the special law .
