摘要
我国的现行相关公证立法对公证赔偿问题规制乏力,实践中对公证赔偿性质认识也颇为不足,导致许多公证赔偿不能顺利进行。公证赔偿属于民事赔偿,雇主责任赔偿,专家责任赔偿;公证赔偿是一种特殊的侵权赔偿,兼具违约赔偿的性质。
The current legislation is weak on the notarizing co mpensation, the nature of the compensation is not known much in practice, a lot of notarizing notarization can not go smoothly. The notarizing notarization is the civil compensation, employer's responsibility compensation, expert's res ponsibility compensation; It is a kind of special tort compensation with the nat ure of compensation for breaking a contract.
