Legal Instruments Shall be Affirmed in Legal Form

法律文书是诉讼的文字凭证,在诉讼过程中有着极其重要的地位。从法制系统看,法律文书得到了司法的认可,但是并没有得到法律形式的确认。因此,法律文书样式在贯彻执行中没有力度,法律文书改革在执行与推广中存在困难。法律文书应以法律形式予以确认已成必要。

Legal instruments are written evidences of litigation and play an important role in the litigious process. Although legal instruments are admitted judicially in legal system, they haven't been affirmed in legal forms, so it is difficult to popularize the patterns of legal instruments and effect the reform of legal instruments in practice. This paper points out the necessity of affirming legal instruments in legal form.
