农村集体建设用地使用权流转中的法律探索

Legal Explore for the Transfer Usufruct of Rural Collective Constrcution Land

改革开放以来,我国城镇国有土地使用制度改革不断取得进展,但农村集体土地使用权建设用地流转制度改革却一直徘徊不前。农村集体建设用地流转制度是否完善直接关系到我国农村、农民的富裕成长,关系到国民经济和社会的科学发展。通过对农村集体建设用地中存在的问题的分析及相关法律制度的探索研究,以期对相关理论研究和实践有所贡献。

Since China introduces reform and opening policies,it has made enromous progress in reforming system of usage state-owned land in urban areas.However,the reform in circulation system of use right of rural collective construction land hasn't made any progress.Whether the circulation system of rural collective construction land has been improved directly is in relation to development of rural areas,richness of farmers,development of economy and society.Through analysing the existed problems in the rural collective construction land and exploring the related legal system,the auther hope to make the contribute for reltated theory research and practice.
