摘要
出口货运代理人作为委托合同中接受委托人委托,负有谨慎、妥善处理货运代理事项,及时交付代理活动所产生财产的基本义务,其中包括向委托人交付出口货运代理过程中取得的由承运人签发的提单。从货运代理这一基本义务入手,分析提单不规范交付的成因、行为的违约性质及与损失之间因果关系等问题。
The freight forwarder of the export goods is obliged to diligently and carefully make shipping arrangements and handle other entrusted matters,and deliver the results of the work thereof,including the bill of lading signed by the carrier,to the principal in the due course.This paper starts with the freight forwarder's fundamental contractual obligations,and then analyzes the causes and nature of misfeasance in bill deliver and the causal relationships between the misfeasance and damages.
