在分析留置权法律制度发展的基础上,结合集装箱批准牌照和证书管理的相关国际公约和国内法,对集装箱不能作为特殊动产而适用物权登记制度进行综合论述,并得出"在不知船公司无权处分集装箱的情况下,港口经营人有权对其合法占有的集装箱行使留置权"的结论,同时建议设立集装箱物权登记和公示制度,进一步完善集装箱担保物权法律制度。
