摘要
我国 2 0 0 0年 8月 2 5日通过的经第二次修订的专利法 ,增加规定了对专利权人的“许诺销售”权 ,文章从“许诺销售”权的立法目的入手 ,论述了许诺销售的概念和外延界定 ,并重新论证了许诺销售侵权的构成要件。
The second edition of China's patent law,passed on August 25,2000,increases the patentee's “offering for sale'. The article starts with the purpose of legislation of “offering for sale',expounds the conception and extension of the right,and proves again the constructive requisites of the infringing the right of “offering for sale'.
