摘要
在审前羁押活动中 ,以及在整个刑事诉讼活动中 ,效率一直是我们致力追求的一个目标。借助于经济分析的工具 ,我们对审前羁押活动进行分析 ,从中可以发现一些基本的规律。如此的规律运用于现实中将会呼唤在立法中及机构设置上的诸多变化 :立法中应对效率观念予以充分的重视 ,应当重视羁押监督机构及羁押过滤机构 ,应当促使羁押机构走向专业化。
Efficiency is one of our goals in the pretrial detaining and even to the whole criminal process. To make use of some economic analyzing tools,we can find many basic rules in the pretrial detaining. And these rules will bring some innovations in the fields of law establishment and judicial organs,such as ,to bring the efficiency thoughts into the legislation,to establish pretrial detaining supervision and filtering administration and to promote the prtrial detainging administration's specialization.
