Elementary Introduction of the Defect and Perfection of the Criminal Legislation on Intellectual Property

我国加入世界贸易组织以后 ,加强知识产权保护的任务更加繁重 ,现行刑法关于知识产权犯罪的规定在打击知识产权违法犯罪行为方面也显得捉襟见肘、力不从心。与时俱进 ,更新知识产权保护的观念 ;完善刑事立法 ,扩大知识产权刑事保护的范围是履行TRIPS协议的一个义务 ,也是知识产权刑法保护的重要基础。

Upon our country entry into WTO,the duty of strengthening the protection on intellectual property is more important,for the present criminal law in connection with attacking illegal criminality on intellectual property also appears implicit and limited. With the development of the circumstance,renewing the conception of the protection on intellectual property,perfecting the criminal legislation,and extending the scope of the protection on the intellectual property are the performance of the obligation under TRIPs and maintenance of the critical basis of criminal protection on intellectual property.
