高职法学教育开展案例教学过程中的几点认识

Understanding in the Course of Higher Vocational Education of Law Carrying Out Case Study

高职法学教育与普通高等法学教育的基本目标是一致的 ,在教学手段上应是一脉相承的 ,不应泾渭分明。那种认为以培养应用型法律人才为目的的高职法学教育没有必要过多的强调对于系统理论知识的把握 ,通过案例教学既缩短了教学情境和司法实践的差距 ,又可提高学生的实际法律技术能力的观点是片面的 ,甚至是极为有害的。我国法学教育教学应以理论讲授法为主 ,以案例教学法为辅。

We should give priority to theoretical teaching method in our educational teaching of law,and take case study method as the secondary one;some requirements should be satisfied to carry out case study. The author then talks about his understanding of case application during case study of criminal jurisprudence.
