摘要
易科制度是一种颇有争议的制度。从刑罚的同一性、刑罚目的和刑事政策三个角度分析,易科制度在我国刑法中存在是可能的。
Exchanged penalty system is a disputable issue. The article expounds the possibility of the exchanged penalty from three following aspects. identity of penalty aim of penalty, criminal policy.
