教育与处罚相结合原则的立法缺憾及科学实现构想

Legislative Defects of the Principle of Combining Education with Punishment and Visualization of Scientific Achievement

教育与处罚相结合是执行治安管理处罚从轻、减轻、不予处罚和不执行拘留等法律规定的必然要求,也是教育违法行为人本人、其他公民、法人、组织自觉守法的客观要求。但在实际运用中存在罚、教不当和教育手段不当创新的实际问题。教育与处罚相结合原则的立法缺憾是导致该问题的主要原因。教育与处罚相结合原则的科学实现有赖于对其含义的统一认识、实施治安管理处罚要充分考虑违法情节、手段、后果、支付能力等综合因素和教育手段的立法完善等方面。

Combining education with punishment is not only necessary requirement in implementing such legal regulations as giving lenient or reduced punishments,no punishment or no detention in public security penalties,but also objective requirement in educating the offenders,other citizens,legal persons and organizations to conscientiously observe the law.There are many practical problems in its practical employment,such as inappropriate punishment and education,as well as old means of education.Legislative defects ...
