摘要
基于社会的不断发展,而致行政行为目的随之不断转化,加之行政效率、行政法治及个案正义的客观要求,皆为行政裁量权适用的存续提供了现实基础。然社会事务的纷繁多样及裁量执行者的主观判断,难免会使行政裁量迷失于僵化与泛滥的两个极端,而致裁量目的难以达成。故为消除此现象,在裁量界限的确定过程中引入激励理论与行政控权理论,并基于此而构建一整套相对健全的激励约束机制,实为行政裁量适用路径的合理探寻。
