论学校对在校未成年学生的侵权责任

On School’s Liability For Minor Students’Tort

学校是未成年学生学习、生活的主要场所,脱离家庭的监督管教和学生的活泼好动决定了在校学生人身伤害事故增多。法学界对学校承担何种责任给予了广泛的关注,笔者从学校的性质、学校与未成年学生的关系入手,论述在校生人身损害赔偿的归责原则,以此明确学校在发生学生伤害事故之后的法律责任和损害赔偿问题,从而切实维护学校、教师和学生的合法权益。

A school is the main place for minor students to study and live. Students’breaking away the control of family and their lively characters decides the increasing accidents of personal injury. The law circle gives wide attention to the liability that the school should bear. From school’s nature and the relation between school and minor students, the article analyzes the imputation principle of students personal injury compensation, and makes clear school’s juridical liability and compensation problem after the accident, hence to defend the lawful rights and interest of school, teachers and students.
