摘要
物权法规定了不动产登记查询制度,但从保证正常适用、规范操作设计,可得行使查询权的主体范围、查询范围以及相应配套制度等等相关问题均须细致探讨,并最终合理确定各种细则,否则该权利将失去操作基础和适用空间。目前,就查询主体而言,立法规定为"权利人"和"利害关系人";就查询范围而言,立法尚未明确,众说纷纭。对此进行深入而有益的探究将有利于增强该制度的可操作性。
