Definition of Incidental Obligation

现代合同法中的合同义务较传统合同义务发生了极大的扩张,附随义务就是其中一个例证,然而学界对此重视不足,附随义务的界定仍处于不统一的状态。以对附随义务全新定义为突破基点,通过对合同关系发生、发展各阶段上的附随义务分别与先合同义务、合同从给付义务和后合同义务的比较,从而实现对合同附随义务的准确界定。

In the modern law of contract,there is much expansion in contract obligation,and supplementary duty is one.However,the academic circle hasn t noticed it.Therefore,there are many divergences in the definition of supplementary duty.This article gives a new concept to supplementary duty,and then compares supplementary duty with per-contract duty,with subordinate duty of contract and with post-contract duty,in order to demonstrate the reasonability of new definition.
