Establishing New Standard of Claim Against Enforcement to Ensure Intervenor's Interest Effectively

案外人提出执行异议的标准通常是所有权 ,但是 ,在社会主义市场经济条件下 ,由于物权理论和实践的发展 ,仍然以所有权作为案外人提出执行异议的标准 ,难以对案外人的合法权益进行有效的保护 ,因此 ,应以物权建立新的执行异议标准 ,以有效保护案外人员的合法权益。

Ownership, in general, is the standard of claim against enforcement put forward by intervenors. However, on the basis of market economy of socialism, with the development of theory and practice of the right of things, it seems difficult to protect interest of invervenors effectively if we still use “ownership' as standard of putting forward claim against enforcement. Accordingly, new standard of claim against enforcement as real right a basis should be established so as to satisfy the legal requirement of intervenors.
