浅谈行政执法自由裁量权

行政执法自由裁量权的行使应遵循合法性原则和合理性原则,兼顾公正与效率。确保行政执法自由裁量权公正有效地实施,一方面要增强执法人员的法治观念,提高法律意识和道德水平等综合素质;另一方面建立相关制度、明确行为责任,以此来约束执法人员合法、合理地行使自由裁量权。

Exercisi ng discretion in administrative enforcement should follow legitimacy principle and rationality principle,looking after both justice and efficiency.In order to ins ure the exercise of it fairly,we should,on one hand,strengthen the law enforceme nt official's law idea,increase the law consciousness and the morals level;on t he other hand,establish the related system and make duty clear,with this control the law enforcement official to exercise it reasonably and legally.
