近十年来国内法经济学研究述评

A Summary of Studies on Law and Economics in China During the Recent Ten Years

作为一种学术思潮,法经济学已经引起了各国学者的重视,并从它的诞生地美国传播到世界其他国家。我国也从20世纪80年代后期开始了法学和经济学相结合的研究进程。近十年来,我国法经济学研究主要集中在对西方现代法经济学著作的翻译引进、相关理论的介绍评析、应用法经济学的理论和方法解释中国现实中的法律制度问题以及对经典作家对法律的经济分析及分析方法的阐释等方面,取得一些成绩,也存在缺陷与不足。

As a trend of thought,Law and Economics has not only aroused sch ol ars' attention greatly but also spread from America,its birthplace,to the oth er countries widly. China also began its studies from the late 1980's. In the r ecent ten years,scholars of China devoted themselves to translate the classical works of Modern Law and Economics and introduce them to China,comment and anal yse the related theories,apply the theories and methods of Law and Economics to solve the practical problems rised in China,and set forth their position on so me classical authors' theories and methods.
