摘要
危险犯既遂标准的确定是危险犯停止形态研究的核心。从危险犯的构成特征看 ,危险犯的既遂是指当行为人的行为造成一定的抽象危险后 ,行为人没有采取相应措施消除这种危险状态 ,以致使该危险状态脱离行为人自力控制而使受保护法益产生具体危险的犯罪停止形态。以此为基础 ,对有关危险犯未遂的一些问题和危险犯中止的认定标准应作新的阐释。
The standard of accomplished offences is the core of the suspended state of perilous crimes. Viewed from the componential characteristics of perilous crimes, the accomplished state of perilous crimes is the state that criminals do not take corresponding measures to demolish the abstract dangerous state caused by their behaviors, make it out of their control, and bring specific dangers to the beneficiaries protected by law. Based on the above views, the author gives new illustrations of some accepted offences and the criteria of the desistance of perilous crimes.
