本文探讨在以法律为主导的法治化制度创新过程中习惯的地位、作用,意在调试习惯与法律,发挥习惯蕴涵的优良品质与积极作用,给予法律内容上的供给与运作上的支持,促成法治之法的完善,力求成功的制度创新。

This thesis probes into the position and the function of the customs in the course of the innovation of institutions in Chinese Law -governing cause. The purpose is to adjust the customs and the law, give full play to the fine qualities and the positive effects of the customs in order to make offerings to the contents of the law and hold out the law in operation. The final aim is to perfect the law of rule of law and make every effort to a successful innovation of institutions.
