Value formation of rendering meritorious service system

立功制度是我国刑法中一项重要的刑罚制度,对于促进犯罪分子改恶从善,重新做人,实现我国刑法的教育功能具有重要意义。但是理论上对其重要价值尚缺乏深入研究。本文在正确界定价值一词基本涵义的基础上,对立功制度的公平价值、效率价值及两价值之间的关系进行了比较深入的分析。

Rendering meritorious service system is an important penal system of our criminal law. It has great importance to improve criminal's idea quality and realize criminal law's educational function. But theoretically,it is still not researched deeply.On the basis of defining the word'value' accuratly,the article makes deep analysis on the system's justice value, efficiency value and their relationship.
