摘要
罪刑法定原则不是禁止刑法解释,只是为刑法解释界定了合理的空间。刑法解释不能违反罪刑法定原则,这是坚定不移的定律。即刑法解释又要在已定的刑法规范中得出符合罪刑法定原则的结论。
The principle of legal definition of crimes does not mean the cancellation of criminal interpretation, but allows a reasonable scope for criminal interpretation. Therefore, criminal interpretation must conform with the principle of legal definition of crimes and reach conclusions that agree with the given criminal norms.
