师生关系是教育教学活动中最基本、最重要、最活跃、最核心的人际关系 ,它关系着教育教学活动的效果和教育教学质量。教师的一切教育教学活动离不开教育活动中最重要、最广泛的主体———学生。教育法律对学校法律关系的规范和调整 ,大多是通过师生关系表现出来。教师的本质特征、权利义务、劳动特点等决定了教师与学生的法律关系是一种复杂的。

The relationship between teachers and students is the most elementary, important, active and key human relationship. It affects both effects and quality of teaching and learning activities. All teachers' activities about teaching cannot deviate from students, the most important and extensive part of education activity. Most of the legal relations at school standardized and adjusted by law of education are shown by the relation between teachers and students. Thus, the legal relation between teachers and students is a complicated and particular relation, according to the teachers' essential characteristics, rights and obligations, laborious features etc.
