从刑事诉讼的根本目的和具体目标上看 ,侦查效率与犯罪嫌疑人权利保护是统一的 ,但由于它们分别代表不同的利益和价值取向 ,二者又是对立的。这种既对立又统一的辩证关系对侦查办案具有重要的指导意义 :二者的统一性强调了保护犯罪嫌疑人权利是有利于而不是有碍于侦查办案 ,因此要求侦查人员改变重实体轻程序、重打击轻保护的观念 ,将打击犯罪、维护社会秩序与犯罪嫌疑人权利保护放在同等重要的位置。二者的冲突性要求侦查人员树立一种均衡观念 ,根据社会现实情况以及维护法治利益和社会秩序的需要作出适当的选择。

From the ultimate aim and specific target of criminal lawsuit, the relationship between investigative efficiency and ensuring suspects' rights is unitary, however, for the reason that they represent different trends in interest and value, they are contradicted. This kind of dialectical relationship being both contradicting and unitary has such important instructive significance in investigating cases as follows: the unity emphasizes the fact that ensuring suspects ' rights is conducive ,but not harmful to investigating cases. Therefore, investigative staff is required to change the ideas of emphasizing entity, while overlooking procedure, and emphasizing strike, while overlooking ensuring , and to place attacking crimes, maintaining social order , and ensuring suspects' rights on the same status. The conflict between them requires investigative staff to set up a balanced idea, that is , to make a proper choice according to the socially realistic conditions and the needs of maintaining legality interests and social order.
