网络犯罪最本质的特征是无地域性和信息媒介的无体性 ,其他特征都来源于此。用传统的刑事管辖原则难以同网络犯罪作有效的斗争 ,普遍管辖原则是对付网络犯罪的必然趋势 ,但是在世界各国尚未签署公约之前 ,可以国籍原则为主 ,兼采有限的保护原则和最密切联系地原则。

The most essential characteristics of Internet crimes are those of being non- regional in actions and invisible in information medium. Accordingly ,other features derive from them. Since it is difficult for the traditional principle of criminal jurisdiction to effectively fight against Internet crimes, the universal jurisdiction principle is the necessary tendency of attacking them. However, before the international treaty is signed, the principle of nationality can be applied as the central one ,with the accompanying principles of limited protection and most close connection.
