The Plight of Legal Globalization

从形式上看 ,法律全球化是法律学人关于法律普适化努力的继续。它具有丰富的内容 ,也有积极的意义。但法律全球化没有经济全球化势头汹涌 ,原因在于在法律全球化的过程中 ,全球化的法律规则会遭遇很多的消解因素 ,如与国家主权、多元文化、价值等会发生冲突。另外 ,复杂的法律解释技术也会使其像国内法一样 ,面临着不同的命运。

Legal globalization, which has abundant contents and active meanings, follows the aims of legal universal applicability that jurisprudents have been pursuing. It is not as remarkable as economic globalization, because of the decomposing factors that it encounters in the realized process itself, such as state sovereignty, multi-culture, legal value,etc. In addition, complicated technology of legal interpretation makes it face different fates just like national laws.
