A Brief Discussion about the Affirmation of Internet Crime

计算机网络的发展 ,为犯罪提供了新的空间。将网络作为犯罪对象 ,即网络对象犯包含着两类行为 ,一是网络用益犯 ,二是网络侵害犯 ,这两类犯罪行为中有的被刑法典明定罪名 ,有的尚无直接相应罪名 ,因此 ,从理论上对其认定予以探讨 ,是十分必要的。

The development of computer network provides new space for crime. Internet target crime, i.e. crime targeting at network, involves two categories of acts, one of which is net-exploiting crime and the other is net-infringing one. And some crimes in these two categories have been given specific charges in accordance with penal law codes, while others not so far. In light of this, it is quite necessary to probe into the affirmation of them from a theoretical perspective.
