论我国土地征收制度之改革

Study on the Reformation of Land Requisition System in China

目前我国存在大量农民集体所有土地被征收、农民利益受到侵害、征地过程中纠纷层出不穷等突出问题。这些问题的出现与现行法律规定不足有关。本文在分析了政府政策目标不一致、利益驱动以及补偿规定不完善登原因后,提出三个方面的改革措施:改变土地利用方式;规范土地征收范围;明确政府、农村集体经济组织、农民的主体地位和相互间的关系。

There are many crucial problems existing in land requisition, such as abuse requisition, infringement upon farmers' interest, and mass of conflicts. They are derivate from. several causes. Then four refonnational methods are brought forward: transform the manners of use; define the range of land requisition; make the status and relationship clear between the state, the collective economy organization, farmer and the user of land.
