全球制度对于国家利益、国家行为、国际交往的社会环境具有深远的意义,国际法治的实现有赖于全球制度的构建和巩固。制度完善的努力主要体现在两个层面:第一,国际立法作为秩序的构划阶段,应融入法治价值,在形式上要逐渐减少法律的不成体系,在程序上应增强国际立法的民主性。第二,国际法的实施作为秩序的实现阶段,需要国家更严格地遵循法律、国际组织提供更有效的监督执行机制,更需要在司法阶段通过普遍、有效的机制促进国际正义的实现。
