以国家法与民间法二元法秩序分析乡土社会的帮工习惯,帮工习惯属于农村中的互助合作规范,是熟人社会以人情关系为基础的民间规则,具有分担民间社会风险的保障功能,主要依靠私人惩罚机制保障实施,背后体现了与国家法截然不同的乡土逻辑。在纠纷解决中,对于帮工习惯与国家法的冲突,应当善用调解等非诉讼解纷手段实现法秩序的沟通。

The paper tries to combine the theoretical pattern with the practical study,so it analyzes the process of a specific dissension under the perspective of rule,discourse and pattern.And the paper draws such a conclusion that the process of mediation displays the balance between the inner law and the outer law,the negotiation between the mass discourse and the experts discourse.And the pattern of state and society discloses the nature of mediation that it is just a balancing process of multiple powers.
