关于网络“挂马”行为的刑法学思考

网络"挂马"行为充分利用了互联网的高效便捷的特性,进而提高了利用木马进行网络犯罪的运作效率。这种"愿者上钩"的犯罪手段日趋成为威胁整个互联网"网络公共安全"的重要因素,这种威胁主要体现在可能带来严重后续犯罪的危险性上。其本质上可以称之为一种"网络危险行为"。而在如此具有严重社会危害性的行为面前,我国刑事立法的打击力度尚需加强。因此,将网络"挂马"这一单一行为入罪无疑具有必要性,另外,基于我国目前互联网发展的现状,这种入罪的措施也具有相当的可行性。
