我国检察机关之定位

The Positioning of Procuratorial Organs in Our Country

检察机关作为国家司法机构的重要组成部分在我国司法实践中发挥着重要作用,但由于在理论上和实务对检察权性质的不同争论而导致对检察机关的定位有分歧,其主流观点认为检察机关是法律监督机关。把检察机关作为法律监督机关有其历史、现实等方面,但把检察机关作为国家法律监督机关有其弊端,对我国的法治实践尤其是法院依法独立行使审判权造成了负面影响,有必要对检察机关的定位进行反思。根据检察机关承担的主要职能并借鉴世界通行做法,应把我国的检察机关定位为国家公诉机关。
