On Counterargument Right While Carrying Out Contracts

为了减少交易风险,新的合同法规定当事人在合同的履行过程中可以依法采取自救方式行使执辩权,根据不同的情况抗辩权分为同时履行抗辩权、先改造抗辩权、后改造抗辩权。

In order to reduce risk of trade, the new Contract Law stipulates that the partyconcerned can perform counterargument right in a self-saving way in the process of carrying outa contract. Counterargument right can be classified as counterargument right for simultaneousperformance, counterargument right for the advance performance, counterargument for thepost-performance.
