教育法学视野中的素质教育

On Well-rounded Education from the Perspective of the Science of the Education Law

摘要 从教育法学上看,受教育权是学生应享有的最根本的权利,是生存权和发展权的基础。不管从反映本质特点的概念性定义考察,还是从实践层面的操作性定义考察,只有以受教育者潜能开发为本位的素质教育,才能使受教育者充分地享有受教育权。 Judged by the Education Law, the right to receive education is the most fundamental right a stu-dent should enjoy, and is the basis of the right to exist and the right to develop. Only well - rounded education,which aims at tapping one's potentialities, can enable the one who receives education to fully enjoy his right toreceive education. This is valid whether analyzed from the conceptual definition which reflects the essence, or ana-lyzed from the operational definition which reflects practice.
