宽严相济刑事政策视野下死缓制度的几点思考

死刑缓期执行制度是我国在世界上独有的法律制度,它充分体现了宽严相济的刑事政策的具体要求。虽然目前该制度在司法实践方面还存在一些问题,但我们不能就此因噎废食,完全废除死缓制度,而应该对其加以改进完善,使其充分发挥宽严相济中"济"的作用与功能,达到控制死刑、限制死刑的目的,真正做到宽严相济。

Suspended the death penalty system is a unique system in the world,which is made by our country.It fully reflects the relief phase of the criminal policy of combination of leniency and harshness of China.Although there are some problems in the judicial practice,we cannot completely abolish the system of death with reprieve.We should make it in a perfect way to control and restrict the death penalty and let it exert the role and function of 'conformity'.
