Comparative Analysis of the Appointed Property System between China and France

约定夫妻财产制是现代婚姻家庭法中一项重要的财产制度。我国现行《婚姻法》在该制度的建构上存在诸多不足之处。对中、法两国夫妻财产约定的形式、法律效力等方面进行比较,建议我国立法机关应在改进现行立法结构、设立夫妻财产契约登记公示制度、补充夫妻财产契约变更等方面加以完善。
