论建立我国刑事诉讼非法证据排除规则的设想

On the Imagination of Establishing the Rules to Exclude the Illegal Evidence in China's Criminal Proceedings

20世纪80年代以来,随着我国刑事司法制度改革的不断深入,以及对国外先进制度和理念的借鉴与思考,各种相关的证据规则逐渐成为专家、学者们探讨的焦点。因此本文研究了非法证据排除规则在我国法治建设中的现状及我国建立非法证据排除规则的具体设想及其配套措施。

Since the 1980s,with the develoment of our country s reformation of criminals and judiciary,and the references and consideration to the foreign countries develoed institutions and atterns,the exerts and scholars begin to focus on the study of the relevant evidences and regulations.Therefore this aer mainly studies how the current situations of rules of law aly in our country and the imagination that our country would establish the rules to exclude the illegal evidence and its supporting measures.
