摘要
宪法赋予检察机关刑事立案监督权,刑事诉讼法却对这项制度的执行或多或少打"折扣",而司法实践中刑事立案监督理念匮乏、体系混乱、监督机关缺乏强制力等问题的暴露进一步说明现行刑事立案监督亟待完善。笔者运用实证分析和比较的方法剖析在检察实践中刑事立案监督的现状和问题,进而提出通过强化监督意识、赋予监督主体更大的权力等举措保障刑事立案监督的落实。
