对我国行政诉讼举证责任的反思——以行政不作为诉讼为视角

Reflection on the Burden of Proof on the Administrative Trial——From the Perspective of Administrative Omission

关于行政不作为诉讼的举证责任,在学界和司法实践中的理解与适用还存在诸多分歧。文章从分析举证责任和行政不作为行为的含义入手,对行政不作为诉讼的举证责任问题进行分析,分析过程紧紧围绕行政诉讼"限制公权、保护私权"的价值取向。通过对行政不作为诉讼举证责任的分析,明确提出行政不作为诉讼举证责任的基本原则与举证范围,实现对构建行政不作为诉讼举证责任体系的有益尝试,以期对审判实践有所裨益。
