环境审判专门化的分析与展望——以我国环保法庭模式为切入点

Analysis and Prospect of Trial Specialization of Environment—a Model of Environment Tribunal

由于环境案件在法律上和技术上的特殊性,环境审判专门化成为司法体制改革的必然趋势。就我国现实状况而言,环境纠纷与日俱增但诉讼极少且无力救济公民权利,审判机制受到多方因素影响而无法正确审理案件。为了应对环境审判的紧迫形势,我国采取环保法庭的专门化审判模式进行试点,不仅具有法律上的依据,而且体现出诸多的优越性。但作为一种新生的审判机制,环保法庭仍然存在诸多问题亟待完善。当然,环保法庭并不是司法推动环保事业的唯一方式,深入探索设立环保法院或者利用现有专门法院等有益途径,可以进一步实现环境审判专门化的目标。

Because of the legal and technical nature of environment cases,trial specialization of environment is an inevitable trend of judicial reform.In our country,environment disputes are growing,but action is little and unable to remedy civil rights,and trial mechanism is affected by various factors so that it can not properly treat a case.In response to urgent situation of environment trial,our country takes an environment tribunal as a mode of specialization pilot trial.It not only has legal basis,but reflects many advantages as well.As a new trial mechanism,there remain many issues which need to be improved.Certainly,since environment tribunal is not the only way to promote environment industry,we should explore many beneficial mathods,such as environmental court and specialized court,to further achieve the goal of specialization of environment trial.
