论单位犯罪自首的成立与认定

The establishment and identification of the unit crime surrender

新刑法确立了单位犯罪的主体地位,但对于单位犯罪理论中的自首认定和处罚问题并没有具体涉及。本文对单位犯罪自首制度的并要性与可行性、单位犯罪自首的认定和单位犯罪自首的处罚三个方面的问题进行了探讨。

The new Penal Code establish the dominant position of the unit crime,but it does not specifically address surrendered identification and punishment in the theory of units.In this paper,Necessity and feasibility of the system of units of crime,identification of the unit crime surrender and penalties of unit crime surrender were discussed.
