上海世博会与衍生产品的法律保护

Shanghai World Expo and the legal protection of derivative products

随着世博会的开幕,涉嫌侵犯世博会知识产权的商品、各种相关的假冒伪劣商品更是呈现出"井喷式增长"的趋势,故完善和加强对上海世博会与衍生产品的法律保护日渐成为国家和世博组委会关注的问题。笔者以上海世博会与衍生产品的知识产权的保护为视角,从知识产权的客体,即著作权、专利权、商标权等出发,分析了上海世博会与衍生产品的法律保护现状,提出了上海世博会与衍生产品的法律保护过程中可能涉及的问题,并阐述了加强对其保护的方法和途径。

With the opening of the Expo,suspected of infringing intellectual property rights in the goods,all kinds of fake and shoddy products related to it is showing a 'growth spurt' trend.Therefore,to improve and strengthen the Shanghai World Expo and derivative products,protection of the law becoming a national concern of the Expo Organizing Committee.The author of Shanghai World Expo and derivatives for the protection of intellectual property perspective,From the object of intellectual property rights that copyright,patent,trademark and other starting,analyze the Shanghai World Expo and the Legal Protection of derivative products,propose Possible implications in the process of Shanghai World Expo and legal protection,and described ways to enhance their protection and means.
