建立和健全自治权的法律保障机制,是涉及进一步完善我国民族区域自治制度,保障自治机关依法行使自治权,使自治权能够真正得到全面落实、正确适用的重要手段。法律保障机制是自治权理论的重要组成部分,也是修改、完善民族区域自治法的重点之一。自治权的法律保障机制应由法律解释机制、审查监督机制、平衡争议机制、违法制裁机制构成。
