公众参与刑事执法的义务感重塑

Remodeling the Sense of Duty of the Public Participation in the Criminal Law Enforcement

公众参与警察刑事执法是提高刑事执法效率的关键因素之一。然而由于种种原因,我国目前公众参与刑事执法的自觉性并不高。因此,需要积极重塑公众参与刑事执法的义务感。只有公众认识到刑事执法者执法行为的合法性时,才能够自觉服从。因此,重塑公众参与义务感的关键是要不断提高警察刑事执法的合法性,特别是要提高警察刑事执法的程序正当性,即刑事执法要给予公众表达的自由,要保持中立,要尊重公众的价值,要给予公众以可信赖感。

The public participation in the police criminal law enforcement is one of the key factors to improve its efficiency.However,due to various reasons,the public’s consciousness of participation in the criminal law enforcement is not high.Therefore,it is necessary to actively reshape the sense of duty of the public participation in the criminal law enforcement.Only when the public are aware of the legality of their actions can they consciously obey the authorities.Therefore,the key of remodeling the sense of duty of the public participation in the criminal law enforcement lies in improving the legitimacy of the police criminal law enforcement,especially the procedural justice.We should give the public the freedom of expression,try to be neutral,respect the value of the public and give the public a sense of trustworthiness in the criminal enforcement.
