试论政府行为约束机制的失缺与构建

On Pestraint Mechanism of Governmental action

目前 ,政府行政管理部门仍然存在政企不分 ,集权审批 ,体制不顺 ,执法不严 ,政府行为缺乏约束机制 ,依法行政意识不到位等问题。政府只有从直接微观管理转向间接宏观调控 ,从重审批重管理转到重执法重服务上来 ,才能规范行政行为 ,提高行政效率。建立政府行为约束机制的主要对策包括 :改革管理体制 ,减少行政审批 ;规范财税管理 ,实施税费改革 ;严格依法行政 ,提高服务水平 ;整顿市场秩序 ,建立健全市场体系。

At present, there still exist some problems in the administrative managemant of the government divisions like the indistinction between the functions of the government and those of enterpirses, the centralized examining and approving, the disorder of the system, the lax law enforcement, the lack of restraint mechanism in governmental action, and unconsciousness of administering the state according to law. The government can only regulate its administrative actions and improve the administrative effciency by converting from the direct micor-management to the indirect macor-control, and by putting more emphasis on the law enforcement and service rather than on the examining and approving. The main strategies of building up a restraint mechanism in governmental action are listed as follows: to alter the system of management; to reduce the work of administrative examining and approving; to regulate the management of finance and tax; to enforce the reform of tax revenue; to administrate according to law; to improve the quality of service; to reorganize the order of the market; to establish the sound system of the market.
