On the Respons Measures That China Deal With the U.S. Specific Safeguard Measures

中美贸易已进入了一个新的历史阶段,但随着两国之间的贸易额的不断上升,贸易摩擦也不断出现,保障措施作为一种贸易救济手段,有被美国扩大适用的趋势。从宏观角度对美国保障措施的发展历史、理论依据、保障措施的实质性构成要件等情况进行梳理,我国输美轮胎不构成实施保障措施条件的原因和美国对我国输美轮胎保障措施的负面影响,以实用主义的视角,中国贸易商应对美国保障措施的具体策略和应对措施。

Sino-US trade has entered a new historical stage.The volume of trade between the two counties continue to rise,the level of economic cooperation continue to improve.However,trade frictions between China and the U.S.continue to occur,and Safeguard Measures as a means of trade relief has the trend of being extended in the development of international trade between China and the United States.In nine years of China's entering into WTO,the United States has implemented over seven safeguard investigations of products from China.And 6 cases were during the Bush administration,but were rejected for different reasons.But in September 2009,Obama government levy punitive tariffs on China's export tire as a means of safeguard measures on the grounds that China's tire exports seriously damaged the domestic industry.This move has attracted worldwide condemnation of trade protectionism.
